Do Massachusetts Break Laws Differ from Federal Break Laws?

Yes, for most employees, Massachusetts break laws differ from federal break laws.

Massachusetts Meal Break Laws

Employers must allow eligible employees to take a meal break lasting at least 30 minutes after working at least 6 hours in a calendar day. The break must free the employee from all duties and permit them to leave the workplace. It can be unpaid.

Employees taking meal breaks can use the time however they choose. They must be permitted to pray if they wish to do so.

Massachusetts Break Laws for Minors

No specific laws around meal or rest breaks for minors are in effect in Massachusetts. However, minors are prohibited from working in certain roles and during specific times of the day.

Massachusetts Break Laws for Mothers

Massachusetts break laws for mothers defer to the federal requirements around pumping breast milk while at work. The Consolidated Appropriations Act, signed into law in December of 2022, provides rights for nursing employees to receive reasonable break time to pump, as well as a private place (that is not a bathroom) to do so. It applies for up to a year after a child’s birth.

Massachusetts Day of Rest Laws

Most employees must be given a day of rest after working 6 consecutive days. The day of rest is defined as 24 hours of rest and must include the interval from 8:00 am to 5:00 pm.

Massachusetts Break Room Requirements

There is no law in effect that requires an employer to provide a break room for employees.

Massachusetts Penalties for Breaking Rest and Break Laws

Employees who believe their break rights were violated can file a complaint with the Attorney General’s Fair Labor Division. An employer that doesn’t comply with the break law could face a fine between $300 and $600 per violation.
