Minimum wage

Minimum wage is the lowest hourly rate that an employee may be paid. It is set forth by the Fair Labor Standards Act (FLSA). The federal minimum wage may differ from state- and location-specific minimum wage, but an employer must comply with the higher of the numbers. For example, the current federal minimum wage is $7.25 per hour, while Washington, D.C. has the highest wage at $15 per hour (as of 7/2020). Employers in Washington, D.C. would need to comply with the $15 wage to meet local standards.

Some exemptions apply. Employees in certain industries are not required to be paid at the state or minimum federal rate. Examples include:

  • Farm and agricultural workers
  • Babysitters (casual)
  • Full-time students
  • Commissioned sales workers
  • Recreational establishment workers
  • Seasonal workers
  • Disabled workers
  • Newspaper employees for certain publications (including delivery people)
  • Companions for the elderly
  • Sea workers on non-American ships/vessels
  • Switchboard operators

 

Tipped workers may also be able to earn a lower hourly wage, as long as the amount plus tips equals at least the federal or state minimum wage, the employee keeps all their tips, or they regularly make $30+ in tips monthly.
